Q. What are my voting rights in the condominiums' Association?
When a vote of members is required, either as an Association member or as an owner in a particular condominium, there is one (1) vote for each unit. Please refer to Paragraphs 6 and 9 of the Declaration of Condominium for your patticular condominium, Article IV of the Articles of Incorporation and Paragraph 2.5 (a) of the By-Laws. The vote must be cast by a designated voter if there is more than one (1) co-owner, or if the owner is a corporation. Designated voting members may vote in person or by a proper proxy. Please refer to Paragraphs 2.5 and 2.6 of the By-Laws for more complete information.
Q. What restrictions exist in the condominiums' documents on my right to use my unit?
There are various restrictions on the use of units. Please refer generally to Paragraphs 12 of your Declaration of Condominium. Additionally, the Board of Directors has the power to make and amend reasonable rules and regulations respecting the use of all property in the Condominium. See Paragraph 12.9 of the Declaration and Paragraph 4 of the By-Laws. Please also see the published rules and regulations of the Association. In addition to other restrictions:
(1) A unit must be occupied only as a single-family dwelling by the owner and members of the family. No condominium unit may be divided or subdivided into a smaller unit. By amendment to the governing documents (12.1) no business use ofa unit shall be allowed.
(2) Only two (2) pets are permitted per unit. Pets of residents or guests may not exceed twenty (20) pounds when fully grown. All pets outside of the units must be on a leash at all times and residents/guests must clean up after the animals.
(3) No “For Sale” or “For Rent” signs or other displays or advertising are permitted on the condominium property.
(4) Each family shall have no more than two (2) automobiles. One is to be kept in the garage. Guest parking is for visitors only – NO parking is allowed on the street.
(5) No truck, motorcycle, commercial vehicle, boat, boat trailer, mobile home, motor home, campers and trailers of every other description shall be parked in the condominium complex, unless it is of a size that fits entirely within the closed boundaries of a resident’s garage where it must be parked when not in use. Any vehicle or vessel that cannot fit entirely inside the garage may not be parked on the condominium property. Normal pick-up and delivery service vehicles are allowed. With prior written approval of the Board, a recreational vehicle may be parked in a designated parking area for a period not to exceed forty-eight (48) consecutive hours.
(6) Outside concrete slabs are limited common areas. Patio furniture should be kept neat and orderly. Owners need to make sure these items are secured indoors during storms, high winds or hurricane warnings. The owner will be responsible for any damage caused by these items. If using the outside concrete slab for a grill, please refer to the information booklet for Grills and Fire Code Requirements.
(7) Construction dumpsters are permitted in the driveway for a maximum of 7 business days with prior approval of the Board.
Q. What restrictions exist in the condominiums' documents on the leasing of my unit?
The leasing or other disposition of units are subject to several restrictions, including but not limited to the right of the Association to approve rentals in advance and minimum lease periods. Please refer to your Declaration of Condominium, at Paragraph 12.6 for more details. No owner shall lease any apartment prior to six (6) months following the date the owner purchased or took title to the apartment. A person or entity, which owns multiple apartments, shall not lease more than two (2) apartments. Briefly, no lease may have a term of less than six (6) months. No separate rooms may be rented, and no transient tenants shall be accommodated in any unit. Prior to the leasing of any unit governed by the Association, the owner of the unit shall submit to the Association for approval the name of the tenant and the lease agreement. An in-person orientation is required. The Association shall be entitled to a screening fee of$50, in an amount not to exceed the maximum amount allowed by law. This fee of $50 shall accompany the request for tenant approval.
Q. Can a family member move into my empty unit?
Yes. You must notify the office, fill out a registration form, and complete orientation.
Q. How much is my monthly maintenance fee to the condominiums' Association for my unit and when they are due?
The monthly maintenance fee for 2025 is $573.00 for all units. All maintenance fees are due on the first day of each month. A late fee of $30.00 is charged on payments received after the tenth (10th) of the month. A return check bank fee of $25.00 is charged to the account. Special assessments may be levied as needed. Please see Paragraph 8 of the Declaration of Condominium for your condominium and Paragraph 6 of the By-Laws of the Association for more information. Q. Do I have to be a member of any other association? If so, what is the name of the association and what are my voting rights in this association?
No, but you should understand that this is a “multi-condominium development”, with one corporation managing two separate condominiums.
Q. Am I required to pay rent or land use fees for recreational or other commonly used facilities? If so, how much am I obligated to pay annually?
No. There are no such fees.
Q. Is the condominiums' Association involved in any court cases in which it may face liability in excess of $100,000? If so, identify each such case.
No.
Q. Where do I procure a set of Association documents? Is there a charge?
A complete and official copy of all recorded documents and recorded amendments for the Association and your particular condominium may be accessed through the condominium office. There is a charge for estoppel information/letters/documents/mortgage questionnaires requested through the condominium office.
Q. Is there a fee for coupon book replacement?
There is a $10 fee to replace the original coupon book.
Q. Is the condominium responsible for postal box key replacement?
No. The postal boxes are maintained by USPS. Your local USPS must be contacted if keys are lost.
Q. When is garbage pick-up?
Garbage pick-up is on Monday, Wednesday, and Friday. DO NOT OVERFILL DUMPSTERS. LIDS MUST CLOSE. Place garbage in another dumpster that is not full. NO BULK PICK UP & NO RECYCLING.
Q. Can I plant whatever I want in my garden area?
No. There are guidelines. Please refer to the Atrium policy.
